Michael Schwegler is a Member in McGlinchey’s Nashville office. A versatile attorney with a background in both transactional and litigation engagements, Mike concentrates his practice in representing creditors and lenders. Mike believes in, and has built his legal practice around, the principle that understanding a client’s business is paramount. Mike provides broad-ranging guidance in every phase of commercial lending operations, including negotiating transaction terms and preparing loan documents; developing compliant loan products, services, and programs; business formation and governance; and closing loans, including real estate, construction, industrial, and asset-backed loans. His representation extends to include bankruptcy and creditors’ rights; workouts; real estate development, zoning, and land use; Article 9 transactions; real and personal property sales; and lien priority issues. By integrating these capabilities, Mike builds longstanding client relationships. His knowledge of their strategic priorities, as well as the competitive landscape and operational challenges they face, enables him to provide legal support that’s simultaneously broad and bespoke; a uniquely customized approach that provides highly effective legal support. By adopting this methodology, Mike operates as a trusted advisor and an integral part of the client’s legal and management team. In addition to his creditor and commercial lending work, Mike is experienced in the law of most other related disciplines, including consumer finance compliance; consumer finance litigation; regulation of financial institutions; aircraft financing; purchase and sale of professional practices; resolution of real estate, land use, title, and leasehold issues and disputes; commercial, single-family, and multi-family repossessions, foreclosures, and post-foreclosure deficiencies; collections; and commercial litigation in state and federal trial and appellate courts.
